Welcome to the NVLSP.org website provided by the National Veterans Legal Services Program (collectively “NVLSP,” “we,” “us,” or “our”). This agreement contains the terms and conditions upon which you may access and use this Site and the information and materials found on this in or about site ("Site").

NVLSP provides access and use of this Site subject to your agreement to the following "Terms and Conditions" (the "Terms"). Please read these Terms carefully before accessing or using the Site. By accessing or using the Site, you agree that you have read, understand, and are bound by these Terms. Please note that NVLSP reserves the right to change the Terms under which this Site and its many offerings are extended to you. Limitation of Liability

Typographical Errors

In the event that a NVLSP product is mistakenly listed at an incorrect price, NVLSP reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. NVLSP reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, NVLSP shall issue a credit to your credit card account in the amount of the incorrect price.

Term; Termination

These Terms are applicable to you upon your accessing the Site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by NVLSP without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Use of Site

Harassment in any manner or form on the Site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a NVLSP or other licensed employee, host, or representative, as well as other members or visitors on the Site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the Site or use the Site to solicit others to join or become members of any other commercial online service or other organization.

Participation Disclaimer

NVLSP does not and cannot review all communications and materials posted to or created by users accessing the Site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the Site, NVLSP is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the Site. Indemnification

You agree to indemnify, defend, and hold harmless NVLSP, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Digital Millenium Copyright Act (DMCA) Notice

The Digital Millennium Copyright Act of 1998, found at 17 U.S.C. § 512 ("DMCA"), provides recourse for owners of copyrighted materials who believe that their rights under United States copyright law have been infringed upon on the Internet. AIR will respond to allegations of copyright violations in accordance with the DMCA. Under the DMCA, the bona fide owner of copyrighted materials who has a good faith belief that their copyright has been infringed may contact not only the person or entity infringing on their copyright, but may also contact the designated agent of an Internet Service Provider (“ISP) to report alleged infringements of their protected works, when such alleged infringements appear on pages contained within the system of the ISP. To file a notification of infringing content a written notification must be submitted.

a. Identification of the work(s) claimed to have been infringed and a statement of ownership to such work(s);

b. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;

c. Information reasonably sufficient to permit us to contact you, such as an address, telephone number and e-mail address at which you may be contacted;

d. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law;

f. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

You may send your notice via email provided such notice includes a proper electronic signature. The signature or electronic signature must be that of the copyright owner, or a person authorized to act on behalf of the owner, of an exclusive copyright that has allegedly been infringed. Please note: The DMCA provides that you may be liable for damages (including costs and attorneys’ fees) if you falsely claim that materials infringe your copyrights. We recommend contacting an attorney if you are unsure whether your content is protected by copyright laws.

Governing Law

Your use of this Site will be governed by the laws of the District of Columbia without giving effect to the choice of law provisions thereof and all parties to these Terms expressly agree to be subject to the jurisdiction of courts in the District of Columbia.
