How You Can Tell Whether You Are a Member of the Class in the Wolfe Case

On September 9, 2019, the U.S. Court of Appeals for Veterans Claims (CAVC) certified the Wolfe v. Wilkie case as a class action so that its ruling would affect all veterans who fit within the Court’s definition of the class.  The Court defined the class as all veterans who had (1) filed a VA claim for reimbursement of emergency medical expenses at non-VA facilities and (2) received VA correspondence stating that VA denied their reimbursement claim for coinsurance and deductible amounts owed under the veteran’s health insurance plan.  This means that you are a member of the Wolfe class if you have ever received VA correspondence stating that VA denied your reimbursement claim for coinsurance and deductible amounts you owed under your health insurance plan.
